General Conditions Of Sale

Preamble:

MAGICAL LAND OF THE INCAS is a company under Peruvian law and is, as such, subject to Peruvian law. Likewise, when entering the territory, our clients must comply with the legislation of the country and any violation of Peruvian laws and the corresponding consequences are their responsibility.

  1. Registration

Registration will be considered effective with the payment of a deposit representing 40% of the total amount of the services, the balance (60%) of the price of the services will be paid at the latest 30 days before the start of the program.

In the case of confirmation with an arrival less than 30 days, the total stay must be paid.

The deposit and balance will be paid in US dollars (USD), either by interbank transfer to the following account:

Bank charges for international transfers are the responsibility of the customer.

Either by bank card (Visa/Mastercard/American Express):

In this case, we will send the customer a link to our secure platform in order to proceed with the payment.

In the case of payments by bank card, the fees associated with this method of payment are 3.50% and must therefore be added to the amount paid (fees applied by the Visanet organization for the use of the payment platform).

The defined rate is calculated based on the number of passengers, a change in the number of participants may therefore result in a change in the rate and/or services under the conditions defined in paragraph 3-a.3.

  1. Price change

Our prices are expressed in US dollars (USD), the international trade currency used in Peru, in order to be as close as possible to the real cost of our suppliers.

In the event of a significant fluctuation (more than 5% general increase) in the elements having a direct impact on the price of the stay (exchange rate between the US dollar (USD) and the Peruvian sol (PEN), transport prices following changes in the price of oil, inflation, increase in entrance fees to tourist sites, etc.) between the time of signing this contract and one month before the start of the services, we may be obliged to modify the defined price.

In this case, the customer has the choice between:

  • Cancel your trip. You will then be reimbursed for all payments made, less bank charges.
  • Confirm your agreement to the new proposed rate
  1. In case of cancellation

In the event of cancellation, for whatever reason, costs outside the trip purchased with TERRES MAGIQUES DES INCAS and incurred by the customer, such as international flight, transport costs to the place of departure of the trip and return home, costs of obtaining visas, travel documents, vaccination costs, insurance costs, bank charges, etc., will not be subject to any reimbursement.

  1. Due to the customer:

a.1. If the customer is forced to cancel his trip for personal reasons (illness, death in the family, etc.), the following penalties will apply:

  • More than 45 days before the day of arrival: 15% of the total services to which is added the cost of flights included in the tourist circuit.
  • Between 45 and 31 days before the day of arrival: 30% of the total services to which is added the cost of flights included in the tourist circuit.
  • Between 30 and 15 days before the day of arrival: 60% of the total services to which is added the cost of flights included in the tourist circuit.
  • Less than 15 days before the day of arrival: 100% of the total services.

In the case of a program including the Inca Trail trek, an additional penalty of 300 USD/person will apply to the penalties mentioned above.

a.2. If the customer cancels following an increase in the rate applied by TERRES MAGIQUES DES INCAS following the conditions mentioned in paragraph 2, the customer will be reimbursed in full, less bank charges.

a.3. Cancellation by one of the participants: If one or more of the participants belonging to the same group cancel(s) their trip, the prices will be recalculated based on the new number of participants.

The customer then has the choice between:

  • Refusing this new price will then be subject to the cancellation conditions of paragraph 3-a.1.
  • Confirm your agreement to the new rate, which will result in the establishment of a new contract under the new conditions.

If TERRES MAGIQUES DES INCAS is forced to cancel its services in a case of force majeure (political, climatic, health events, etc.), the customer will be reimbursed for the amounts paid, less bank charges and non-refundable fees according to the policies of the various service providers applied in this case of force majeure (airlines, train companies, organizations managing entrances to tourist sites, etc.). This reimbursement will be made after the reimbursement of the amounts committed by TERRES MAGIQUES DES INCAS by its various service providers.

  1. Interruption and/or modification of the trip
  2. Due to the customer:

If, for whatever reason, the customer modifies or interrupts his trip prematurely or decides not to do an activity planned in the program, no reimbursement of services not carried out will be provided and services not initially defined remain the responsibility of the customer.

  1. From MAGICAL LANDS OF THE INCAS

TERRES MAGIQUES DES INCAS reserves the right to modify the dates, times or planned itineraries in the event of force majeure, if it considers that the safety of the traveler cannot be ensured and this without the latter being able to claim any compensation, it being understood that TERRES MAGIQUES DES INCAS undertakes to offer the most suitable alternatives to the cancelled or modified services so that the impact on the trip remains minimal.

  1. Insurance

As a company under Peruvian law, TERRES MAGIQUES DES INCAS is not authorized to offer insurance to non-residents in Peruvian territory. Therefore, it is up to the customer to contract this type of service himself in his country of origin.

It is strongly recommended to take out repatriation assistance insurance.

In the event that you do not wish to take out any insurance, you will have to sign a liability waiver, exonerating TERRES MAGIQUES DES INCAS.

  1. Responsibilities

Each participant must take responsibility for obtaining all documents required by the authorities of the countries visited (passport, vaccinations, etc.).

TERRES MAGIQUES DES INCAS is not responsible in the event of a delay or inability of a participant to present valid documents. The costs incurred on this occasion and any services that could not then be carried out are the responsibility of the client.

It is the customer’s responsibility to check that their documents, particularly administrative and health documents, required for the completion of the trip, comply with the administrative obligations in force.

TERRES MAGIQUES DES INCAS cannot, under any circumstances, be held responsible for the consequences of the customer’s failure to comply with customs or health police regulations, prior to and during the trip. A customer who cannot board a flight due to not presenting the required documents mentioned on the registration form given to him/her, cannot claim any refund.

  1. Risks

Each participant is aware that he may run certain risks (distance from medical centers, road conditions, etc.). He assumes them with full knowledge of the facts and undertakes not to hold TERRES MAGIQUES DES INCAS or the guides or the various service providers responsible for any accidents that may occur.

If circumstances require it, particularly to ensure safety but also for climatic reasons or unforeseen events, TERRES MAGIQUES DES INCAS reserves the right, directly or through its guides, to substitute one means of transport, accommodation, or itinerary for another, as well as the departure dates or times, without participants being able to claim any compensation.

  1. Air transport

If the customer’s trip is modified due to a disruption in air traffic, whether for climatic or operational reasons specific to the airline, TERRES MAGIQUES DES INCAS cannot be held responsible. The resulting costs would remain the responsibility of the customer.

  1. Luggage

At all times the client is responsible for his luggage and personal effects. Drivers and guides are not responsible for monitoring luggage and checking that nothing is forgotten in the vehicles or on the sites visited. TERRES MAGIQUES DES INCAS is in no way responsible for the loss of personal items which remain at all times and in all circumstances the responsibility of their owners.

In the event of a dispute in the interpretation of the conditions defined above, an amicable settlement will be proposed in the search for a balance established on concessions and mutual understanding.
